Do conservation areas protect trees?

Yes — separately from Tree Preservation Orders. If a property sits within a conservation area, many trees there have a degree of protection even if no individual TPO has been made for that specific tree. This is a common source of confusion, because people often assume that no TPO means no restriction, which isn’t necessarily the case inside a conservation area.

What do I need to do before working on a tree in a conservation area?

In general terms, anyone intending to cut down, top, lop, uproot, wilfully damage or wilfully destroy a tree in a conservation area (above a certain minor size) is required to give the local council advance written notice of what’s proposed, before carrying out the work — this gives the council the opportunity to consider whether to make a Tree Preservation Order to protect the tree, if they consider it merits protection. Exact notice periods and exemptions (for example for very small trees, or trees already covered by a TPO) are set by planning legislation and can have specific detail that matters, so this is genuinely worth checking with the council rather than assuming.

Why this trips people up

A tree can be completely healthy and never have been individually assessed or flagged by the council, and still require notice before work simply because of where it stands. This applies to routine work too, not just removals — significant pruning, crown reduction or lopping can also be caught by the same requirement.
